II. JURISDICTION This Court has subject matter jurisdiction of this case pursuant to 28 U.S.C. § 2241(d). Petitioner was indicted for the offense of capital murder in the 346th District Court of El Paso County, Texas. Petitioner is in the custody of the Texas Department of Criminal Justice pursuant to this judgment and death sentence. Under 28 U.S.C. § 2244(d)(1), a petition filed on or before July 25, 2002, was timely. Mr. Ford's original federal petition was filed on July 25, 2002. |
