Le terme poste à poste est la traduction (initialement adoptée au ) de l' Peer-to-Peer (ou aussi Point-to-Point ), laquelle est souvent abrégée P2P .
C'est là l'origine du terme pair (ou peer ) que l'on trouve dans pair-à -pair: les communications et les échanges se font entre des nœuds qui ont la même responsabilité dans le réseau.
S’il est au départ créé dans une autre optique (son créateur, , un jeune étudiant américain de 18 ans, souhaitait pouvoir facilement échanger de la musique avec ses amis), il devient rapidement dédié au téléchargement de médias au format sur en s'appuyant sur la technologie ( peer-to-peer ) centralisée .
Dès lors, le téléchargement illégal fait partie intégrante du phénomène Internet et les logiciels peer-to-peer deviennent les nouvelles applications à la mode.
Ce facteur commercial provoque l’émergence de nouveaux comportements sur les réseaux peer-to-peer , les internautes laissent Kazaa fonctionner pendant qu’ils font autre chose (surf par exemple) puis dans un deuxième temps ils laissent leur PC connecté en permanence.

Aumentano le azioni legali, portate, a volte, in maniera indiscriminata, contro gli utenti dei sistemi Peer-to-Peer.
La questione se il Peer-toPeer sia illegale o meno non è una questione giuridica facile da risolvere.
Soprattutto, non tutti i giuristi sono concordi, in Italia e nel mondo, nel ritenere il Peer-to-Peer illegale in sé, anzi.
In realtà sono molto differenti le ipotesi criminali alla base di azioni di pirateria e falsificazione su larga scala (spesso collegate a fenomeni di criminalità organizzata e contrabbando) e il Peer-to-Peer di utenti comuni, non certo criminali, ma molto spesso semplici appassionati di musica.
68, entrato in vigore il successivo 29 aprile (quel decreto che avrebbe introdotto i principi dell'EUCD nel nostro ordinamento e che avrebbe portato un "giro di vite" alla disciplina) abbia esteso al Peer-toPeer nuove ipotesi criminali.
Detto in termini meno giuridici, è vero o non è vero che dal 2003, in Italia, sono cambiate le cose e il Peer-to-Peer è diventato illegale? Leggendo le dichiarazioni apparse in tante sedi, soprattutto da parte di operatori del settore musicale e audiovisivo, sembrerebbe di sì.
Non è vero, infine, che tutti i giuristi e gli esperti, in Italia, non abbiano dubbi circa la illiceità del Peer-to-Peer.
