Summary In March 1997, the Commission adopted service rules for satellite digital audio radio service (SDARS) authorizations in the 2320-2345 MHz frequency band.. In conjunction with the service rules, the Commission issued a Further Notice of Proposed Rulemaking (See 62 FR 19095 (April 18, 1997), seeking comment on the proposed use of SDARS repeaters which some applicants intended to implement, as necessary, in urban canyons and other areas where it may be difficult to receive DARS signals transmitted by a satellite.. Since the Further Notice, the Commission has received detailed technical information on the SDARS repeaters and significant comment from the Wireless Communications Service (WCS), Multipoint Distribution Service (MDS), Instructional Television Fixed Service (ITFS) licensees and the SDARS licensees on terrestrial repeater licensing.

The scope of this license was expanded in 1998 upon passage of the Digital Millennium Copyright Act of 1998 ("DMCA" or "Act"), Public Law 105-304, in order to allow a nonexempt eligible nonsubscription transmission and a nonexempt transmission by a preexisting satellite digital audio radio service to perform publicly a sound recording in accordance with the terms and rates of the statutory license.. The transmission must also be made as part of a service that [[Page 2195]] provides audio programming consisting in whole or in part of performances of sound recordings which purpose is to provide audio or entertainment programming, but not to sell, advertise, or promote particular goods or services.. A "preexisting satellite digital audio radio service" is a subscription digital audio radio service that received a satellite digital audio radio service license issued by the Federal Communications Commission on or before July 31, 1998.. Only two known entities, CD Radio and American Mobile Radio Corporation, qualify under the statutory definition as preexisting satellite digital audio radio services.

On February 12, 2001, the Copyright Office published a Federal Register notice initiating a voluntary six-month negotiation period to establish rates and terms for the statutory license covering new subscription services.. After the close of the negotiation period, the Office received petitions from Music Choice and RIAA requesting that the Librarian of Congress convene a CARP to establish terms and rates for the statutory license covering new subscription services.
